This Festschrift in Professor Kristeller’s honor consists of contributions by scholars who have had some connection with Columbia University, his "intellectual home in the United States for three decades." It also includes a Tabula Gratulatoria listing many other friends from the United States and Europe. The editor’s opening essay provides an interesting and informative account of this scholar’s academic career, and should be read together with the complete annotated bibliography of his publications through 1974. The latter lists 149 "major publications" (...) and 220 "minor publications." Kristeller’s contributions to the history of Renaissance philosophy are well known to historians of philosophy, and deservedly so. Here reference should be made to his groundbreaking studies on Marsilio Ficino and Pomponazzi, and on others such as Pico della Mirandola and Petrarch, as well as on Renaissance Platonism, Aristotelianism in the Renaissance, Thomism in the Renaissance, Paduan Averroism, and Alexandrism. But he has also contributed greatly to the fields of medieval and Renaissance history, and especially to our understanding of Renaissance humanism, Renaissance music, and Renaissance art. He is universally recognized as one of the world’s foremost authorities on manuscript research, as is witnessed, for example, by the cooperative project, Catalogus Translationum et Commentariorum, which he founded, and by his Iter ltalicum. In all of these enterprises he has set an enviable example for other scholars by the exacting standards and the breadth of his expertise. It is only fitting, then, that the many essays in this Festschrift should reflect the breadth and depth of the scholarship so evident in the man to whom they are dedicated. If the contemporary rebirth of the ontological argument had its conception in Norman Malcolm's discovery of a second Anselmian argument it had its full-term delivery as a healthy philosophical progeny with Alvin Plantinga's sophisticated modal version presented in the tenth chapter of The Nature of Necessity. This latter argument has been the centre of a huge body of literature over the last fifteen years, and deservedly so. Woodward's long awaited book is an attempt to construct a comprehensive account of causation explanation that applies to a wide variety of causal and explanatory claims in different areas of science and everyday life. The book engages some of the relevant literature from other disciplines, as Woodward weaves together examples, counterexamples, criticisms, defenses, objections, and replies into a convincing defense of the core of his theory, which is that we can analyze causation by appeal to the notion of manipulation.

This paper argues that Wittgenstein, both early and late, rejects the idea that the logically simpler and more fundamental case is that of "the mere sign" and that what a meaningful symbol is can be explained through the elaboration of an appropriately supplemented conception of the sign: the sign plus something. Rather the sign, in the logically fundamental case of its mode of occurrence, is an internal aspect of the symbol. The Tractatus puts this point as follows: “The sign is (...) that in the symbol which is perceptible by the senses.” Conversely, this means that it is essential to a symbol – to what a symbol is – that it have an essentially perceptible aspect. For Wittgenstein there is no privileged direction of explanatory priority between symbol and sign here: without signs there are no symbols and without some sort of relation to symbols there are no signs. Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily concerned with (...) the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. Charity and prudence serve distinct functions. In Thomas's position, a person can have the acquired virtues without having charity; such a person has a (...) virtuous life, but it is unified by prudence, not by charity. But why is such a person without charity? Is this absence of charity due simply to the absence of faith? Is this person with the four acquired virtues but without charity simply an unbeliever? Or is this person simply a rightly-ordered person whose lack of charity is due to the absence of personal moral goodness? Is such a person simply one who, in common parlance, is a well-integrated person but not necessarily a morally good one? In a word, is moral goodness a necessary condition for the acquired moral virtues? To answer this question we will begin with the contemporary distinction between goodness and rightness and then discuss the two virtues and their functions. In the final section we will relate our findings to present-day problems in the ethics of virtue. I. Goodness an_d Rightness Since Democritus we have realized that living rightly is not necessarily an indication of being good. Democritus noted that being good required not only that we act rightly but that we want 407 408 JAMES F. KEENAN, S.J. to act rightly.1 Over the centuries philosophers and theologians have consistently made reference to the fact that living rightly, or as they called it " doing the good," was not a sufficient condition for describing a person as good. From Ambrose and Augustine to the present, authors have insisted that a moral description of persons is more than a mere deduction from external activity.2 Some writers, however, did not simply make reference to this distinction, but rather spent considerable time in commenting on the insight involved. Kant, for instance, in his Foundations of the Metaphysics of Morals distinguished from the beginning between action!> done out of duty (Handeln aus Pfiicht) and dutiful actions (pfiichtmiissiges H andeln). In attempting to describe the only thing which we can call " good," that is, the will, Kant argued that a dutiful act was only good if the act was done out of duty. For example, a state executioner who executes on account of his duty to execute is good and the action is good. But if the executioner performs the dutiful act on some other account, then the action is not good, though it is dutiful. Interestingly Kant did not consider whether an act not dutiful could be called good: Is an executioner who acts out of duty but botches the job still to be called good? George Moore in his Ethics made a similar point but for different reasons. Unlike Kant's interest in goodness, Moore wanted to describe a right action free of any consideration of an agent's motives and his solution was utilitarianism. The question of the cause of inertial reaction forces and the validity of “Mach's principle” are investigated. A recent claim that the cause of inertial reaction forces can be attributed to an interaction of the electrical charge of elementary particles with the hypothetical quantum mechanical “zero-point” fluctuation electromagnetic field is shown to be untenable. It fails to correspond to reality because the coupling of electric charge to the electromagnetic field cannot be made to mimic plausibly the universal coupling of gravity (...) and inertia to the stress-energy-momentum (i.e., matter) tensor. The gravitational explanation of the origin of inertial forces is then briefly laid out, and various important features of it explored in the last half-century are addressed. (shrink)

The effectiveness of case-based learning in ethics education varies widely regarding how cases are presented. Case process instruction may impact case-based ethics education to promote sensemaking processes, ethical sensemaking strategy use, and ethical decision making (EDM) quality. This study examined two teaching techniques, notes and review, and participants completed note-taking and review activities examining a case-based scenario during an ethics education course. Results suggest that providing case notes in outline form improves sensemaking processes, strategy use, and EDM quality. Over the past forty years, the administrations of American colleges and universities have developed and expanded the ranks of contingent faculty as an alternative to the tenure line. While acknowledging the gross inequities that divide these two tracks, this essay attempts to awaken tenure-line ethicists through the concept of recognition to the conditions of their colleagues and then argues through the concept of vulnerability that faculty are deeply and unavoidably related, and concludes that through solidarity ethicists from both lines might (...) work together toward the university becoming a more ethical workplace than it presently is. Like Frege's distinction of sense and force in semantics, the central distinction of pragmatics is that between perlocutions and illocutions. All speech acts theorists offer a version of this distinction, including Habermas in his theory of communicative action. However, whether or not there is such a distinction at all remains an essentially disputed issue. In this paper I consider the importance of this distinction for analyzing both ideology and rhetoric, but in particular for analyzing one species of rhetorical speech for (...) the purpose of changing beliefs, that engaged in by the social critic. To make these substantive points, I must first consider important recent criticisms of Habermas's distinction, especially those of Erling Skjei and Allen Wood. While I agree with the core of both criticisms, I still think the distinction can be made along the lines that Strawson proposed. I argue that there is not a completely disjunctive, mutually exclusive set of properties defining each type of speech act. There are, and must be, overlapping, nontrivial features common to both. These common features are in fact crucial to the analysis of the sort of speech engaged in by social critics and emancipators. To show this, I argue for the existence of an intermediate class that I call "communicative perlocutions." This class, in turn, overcomes the traditional, Platonic enmity to rhetoric which ought not be imported unquestioned into the philosophy of language or the justification of rational social criticism. The Faradayan hypothesis of inductive coupling of the electromagnetic and gravitational fields is briefly discussed. An experiment designed to test the hypothesis wherein samples are spun to see if any electrogravitational charge is induced is described. Results of the experiment are reported. They imply the induction of a charge density ρ* for spinning samples that behaves as ρ*=βρma, where ρm is the mass density of an element of matter experiencing an acceleration a, and β is the coupling coefficient for the (...) hypothetical electrogravitational induction effect. In this experiment, β is found to have the value(9.6±3.3)×10 −13 statcoulombs/dyne. Tests that seem to rule out explanations of the observed charges in terms of conventional charging mechanisms are considered. (shrink)

This article focuses on the deliberations of the National Institutes of Health Human Fetal Tissue Transplantation Research Panel in 1988. It explores various arguments for and against the use of fetal tissue for transplantation research, following elective abortion, and for and against the use of federal funds for such research. After examining the relevance of various positions on the moral status of the fetus and the morality of abortion, the article critically examines charges that such research, especially with federal funds, (...) would involve complicity in the moral evil of abortion, would legitimate abortion practices, and would provide incentives for abortions. Finally, it considers whether the donation model is appropriate for the transfer of human fetal tissue and whether the woman who chooses to have an abortion is the appropriate donor of the tissue. Quine claims that the analytic-synthetic distinction lacks a proper characterization of a notion to be used to reduce analytic statements "depending upon essential predication" to logically true statements. the author shows that the same arguments used by quine against analyticity can also be used against logical truth; if one notion is "given up", the other must be also. notions such as "filling blanks alike" and "identical propositions" presupposed by logical truth have the same deficiencies as does analyticity. logical truth is (...) not more basic than analyticity; the two notions stand or fall together. Philosophy studies the relation between random, routine, and reflective thought and action. It is in essence the reflective study of routine. No one can survive a random world, but a routine world will generate the same randomness it is intended to avoid owing to the inevitable errors associated with routines. The prime function of reflective inquiry is to identify and explain the logical foundation of these errors. While governments depend on strict routine to prevent anarchy, it is only with the (...) maintenance and adaptive revision of those routines that they are able to serve that purpose. Thus philosophy is essential even to preserve routine, aside from facilitating the building of better routines. To advance global understanding philosophers need to use informal means to communicate to all people everywhere the distinction between randomness and routine, and the transcending of routine by reflective study. I add a concluding note of advocacy for UNESCO’s Strategy on Philosophy. (shrink)

This essay explores some of the conceptual and moral issues raised by illegal actions in health care. The author first identifies several types of illegal action, concentrating on civil disobedience, conscientious objection or refusal, and evasive noncompliance. Then he sketches a framework for the moral justification of these types of illegal action.
